Terms and Conditions

1. Acceptance of Terms

By creating an account on Tailor Man ("the Service", "we", "us", or "our"), you ("User", "Tenant", "you") agree to be bound by these Terms and Conditions. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these terms.

If you do not agree to these terms, do not use the Service.

2. Description of Service

Tailor Man is a cloud-based shop management platform designed for tailoring businesses. The Service provides tools for:

• Bill and order management
• Customer and measurement profiles
• Production tracking and workforce management
• Inventory, expense, and wage tracking
• Reports and business analytics

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice to active subscribers.

3. Accounts and Registration

To use the Service, you must register with a valid Google account. You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Ensuring all information you provide is accurate and up to date
• Notifying us immediately of any unauthorized access to your account

Each business ("Tenant") operates as a separate, isolated workspace. Staff members you add to your account are bound by these terms through your acceptance on their behalf.

You must be at least 18 years old to create an account. Accounts created on behalf of a business must be created by an authorized representative of that business.

4. Subscriptions and Payment

Free Trial: New accounts receive a 30-day free trial with access to all features. No payment information is required during the trial.

Paid Plans: After the trial period, continued access to the Service requires a paid subscription. Plan details, pricing, and features are displayed on our pricing page and in the Super Admin settings. We reserve the right to change pricing with 30 days' notice to existing subscribers.

Payment: Subscription payments are processed manually via UPI or bank transfer as communicated by our team. Failure to pay within the grace period may result in account suspension.

Refunds: We do not offer refunds for partial subscription periods. If you cancel, your account remains active until the end of the current paid period.

Grace Period: Accounts that miss a renewal date receive a grace period before suspension. Data is not deleted immediately upon suspension.

5. Your Data

Ownership: You retain full ownership of all data you enter into the Service, including customer information, bills, measurements, and business records. We do not claim ownership over your data.

Storage: Your data is stored securely using Google Firebase (Firestore and Firebase Storage), located in data centres compliant with industry security standards.

Access: We may access your data only as necessary to provide technical support, resolve disputes, or comply with legal obligations. We do not sell your data to third parties.

Deletion: Upon account termination at your request, we will delete your data within 30 days. Data in backups may persist for up to 90 days.

Customer Data: You are responsible for ensuring you have the legal right to collect and store the personal data of your customers (names, phone numbers, measurements, etc.) and for complying with applicable privacy laws including the Digital Personal Data Protection Act, 2023 (India).

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Upload or transmit any content that is unlawful, harmful, defamatory, or obscene
• Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell, sublicense, or commercially exploit the Service without our written permission
• Introduce viruses, malware, or any other malicious code
• Engage in fraudulent transactions or misrepresent your business

Violation of these rules may result in immediate account suspension without refund.

7. Intellectual Property

The Tailor Man software, including its design, code, branding, and user interface, is our intellectual property and is protected by copyright and other applicable laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes.

You may not copy, modify, reverse engineer, or create derivative works of the Service without our express written permission.

8. Disclaimers and Limitation of Liability

No Warranty: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Uptime: We strive for high availability but do not guarantee uninterrupted access. We are not liable for downtime caused by factors outside our reasonable control, including Firebase/Google infrastructure outages.

Limitation: To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of data or business profits.

Data Loss: While we take reasonable steps to protect your data, we recommend maintaining your own backups of critical business records. We are not responsible for data loss due to circumstances beyond our control.

9. Termination

By you: You may terminate your account at any time by contacting us. Upon termination, you will lose access to the Service and your data will be scheduled for deletion per Section 5.

By us: We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms. We may also terminate accounts for non-payment following the grace period.

Sections 5 (Your Data — deletion obligations), 7 (Intellectual Property), 8 (Disclaimers), and 10 (Governing Law) survive termination.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

11. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email or a prominent notice within the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
